The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency sparked by the announcement of a new 28-point plan for ending the war appeared – momentarily – to have been stabilised. A senior US official spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the current period. By day, diplomatic battles are fought: optimistic declarations are delivered from various governments. Immense energy is allocated on containing particular approaches. By night, the Kremlin clearly shows the world that, for them, war remains the key method for achieving "resolution".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was laid bare. Ukraine is able to track projectile deployments from Russian territory, a ability enabled by up-to-date information. From witness perspectives, military aircraft that had been scrambled to intercept incoming aerial threats streaked across the sky – advanced fighter aircraft delivered to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems engaged: multiple launches fired to intercept a hostile projectile. This was a modern interception technology at work, presumably provided by partner states. Every deployment shakes the surroundings, shaking the windows. The brief panic quickly gives way to resigned acknowledgment: perhaps the incoming missile won't cause damage this time, preventing destruction from ruin and additional electricity failures.

Continuous Dangers

Soon after, a large-caliber weapon engaged a drone somewhere nearby, part of a mobile-fire group – most likely imported technology. Unfortunately, the shots failed to hit the hostile drone – it continued its flight toward its objective.

Periodically, this continued until dawn. Kyiv faced the early updates: seven people killed, destruction and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As typically, everyone still maintained normal activities – experiencing conflict. But those entire period demonstrated Ukraine's essential dependence on Western support – a dependence that regional partners are evidently unprepared to replace in the near term.

Ineffective Peace Efforts

The detailed framework from Washington provoked deep reactions, discussion and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new approach from Washington follows the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, effectively counters. They contain the crisis but never actually achieve victory. This trend will, certainly, continue.

Tactical Assessments

It is convenient to criticize particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the whole story. American leadership operates on a principle well known to experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The US administration presumes that it is impossible to force Russia to relinquish the territory that it presently holds in Ukraine's south or east.

The issue is that while acknowledging this situation, Washington does little to prevent Kremlin actions, through statements or actions, from thinking that the situation will not change more in its benefit in the near future.

Conflicting Perspectives

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its allies are coming close to fatigue. Their motivation to accept conditions that does not give them the greatest potential benefit is almost completely absent. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing civilians and areas but avoiding a entire defensive failure until circumstances change in its benefit.

Present Conditions

Realistically, there are no real preconditions for a ceasefire. Now, personal considerations are entering the equation: political desires to negotiate peace and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any proposal Kyiv finds unworkable, so that their priority does not switch to homefront challenges. And although their task will now be significantly challenging after latest incidents, it remains highly unlikely that this will modify their basic position.

These opposing factors are guiding negotiations.

Assessment and Future

It took a just a single week to terminate the 28 points of the current initiative. Aggressive and erratic handling of the matter by US administration, resistance by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, latest revelations, all served their function.

While new initiatives based on previous concepts are forthcoming, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and demonstrate certain reluctance to modify developments, if they maintain solidarity and improve their protective measures at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, primarily depend on sustained allied backing.
